1. Definitions

• "BUYER" refers to any individual or business purchasing, using, or recommending Angle Oar products, including but not limited to those who borrow or use the products, such as in a program or rental environment, but are not the original purchaser.

• "RELEASED PARTIES" includes Angle Oar, LLC, its affiliates, and specific organizations such as YakAttack, Ram Mounts, Wave Armor, RailBlaza, YakGear, as well as any business entity associated with the sale or distribution of Angle Oar products such as Eddyline Kayaks, Abilities in Motion and JGH Rehabilitation Consulting Services.

2. Acknowledgment of Risks

​

• I understand that using products like the Versa Paddle System, Gamut Paddle Holder System, Mounts, Stabilizing Outriggers, Kayak Carts, Roof Racks, and Accessories involves inherent risks, including the possibility of serious injury or death. I recognize that improper installation can exacerbate these risks. I agree to follow all provided installation instructions carefully. The BUYER acknowledges that both individuals and businesses using Angle Oar products assume all risks inherent in kayaking and related activities, including risks arising from the condition of the products and the actions of their employees or representatives.

 

3. Release of Liability

• In consideration of my purchase, I hereby release Angle Oar LLC, its partners, consultants (including Cathy Webster), and the Northeast Disabled Athletic Association from any liability for injuries, deaths, or damages resulting from the use or misuse of these products. This release applies to all claims, including those for negligence, and encompasses any related costs or attorney fees.

 

4. Consultants and Partners

​

• I acknowledge that Cathy Webster, as a consultant for Angle Oar LLC, provides guidance on adaptive kayaking equipment and that the Northeast Disabled Athletic Association (NDAA) is a partner organization involved in promoting adaptive sports. I understand that any advice provided by them does not constitute medical or safety advice.

 

5. Indemnification

• I agree to defend, indemnify, and hold harmless Angle Oar LLC and its Indemnitees from any claims or damages arising from my use of the products, including claims from third parties related to the actions or omissions of businesses using the products, except in cases of gross negligence or willful misconduct by Angle Oar LLC.

6. No Medical Advice

​

• Any advice or consultation provided by Angle Oar LLC or its representatives does not constitute medical, safety, or business advice. Any discussions or advice regarding product use are strictly informational, and the BUYER is solely responsible for any decisions made based on such information.

7. Voluntary Agreement

​

• I have read and fully understand this waiver and release. By using the products, I acknowledge that I waive my right to any claims against Angle Oar LLC or its partners, even if I later become dissatisfied with this agreement.

 

8. Warranty Disclaimer

​

• Angle Oar LLC provides no warranties, express or implied, regarding the products’ fitness for a particular purpose or their safety.

 

9. Severability Clause

​

• If any provision of this Disclaimer of Liability is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.

 

By purchasing and using these products, I confirm that I accept these terms.​
